Gorilla Safari Experience Limited (the company) marshals safaris in Uganda, Congo, Tanzania, Kenya and in Rwanda.

Prithee read these Terms and Conditions cautiously as they set out our relevant onus and form the foundation of your contract with us. In these terms and conditions, “you” means all persons dubbed on the booking (including anyone who is added or substituted at a later date) and “we” and “us” means Gorilla Safari Experience Limited. These terms are altered from time to time due to varying circumstances; the terms at the time of booking are the terms that are legitimate. Situations in Africa are not the same as those in urbanized countries and standards of service, medical facilities, safety and security may often be lesser than those in your home countries. Kindly note that it is the laws and regulations of the country in which services are provided which pertain to your holiday provision and not those of your home country

ACCURACY OF INFORMATION

The elucidation, data and views provided by us regarding national parks, animal sightings, housing, itineraries, gorilla licenses and safety are provided in good faith, based on the latest data accessible to us. Every care has been taken to guarantee the precision of the information provided. We cannot acknowledge any accountability or liability for any errors or omissions caused by matters ahead of our control.

ACCOMMODATIONS

Unless an unambiguous accommodation is requested, we set aside or propose the best or mid range facility, convincingly priced charismatic hotels/lodges with private bath, hot water, superior service and value. Prices are based on two persons sharing a double or a twin-bedded room. We set aside the right to surrogate corresponding or better-quality hotels. We make every effort to organize shared accommodations for single travelers when requested to do so. If the appeal cannot be thrilled, the quoted single increment will apply.

CANCELLATIONS BY US

Sporadically we have to revoke incorrigible bookings. We always venture to avoid canceling, but we must preserve the right to do so.

We shall not annul your incorrigible holiday less than 60 days before leaving unless we are strained to do so as a result of atypical and unforeseeable situations past our control, the penalty of which we could not have avoided even with all ample care. If we annul your holiday (except where you have botched to make payment or as a result of vis major) we shall proffer you the choice of purchasing a different holiday from us of an analogous standard to that initially booked if available. If the chosen substitute is less expensive than your original holiday we shall reimburse the difference but if it is more expensive, we shall ask you to forfeit the difference. Otherwise you are free to a full refund of all levies you have paid to us save that paid for gorilla permits which can only be reimburse if the refund has been made available to us. Except where we cancel for reasons other than those divulged in this clause, we shall have no further liability to you. We regret we cannot pay any expenses, costs or losses incurred as a result of any annulment.
We reserve the right, without aforementioned notice, to lapse the holiday of any person in your party if, in our perception or in the perception of any other person in authority, the persons concerned behave in such a way to cause or be likely to cause danger, exasperation or agony to any third party or dent to property. In this condition, the person(s) concerned will be required to leave the accommodation or other service instantaneously. We shall have no further accountability towards such person(s). No refunds will be made and we shall not forfeit any expenses or costs incurred as a consequence of the termination.

CANCELLATIONS BY YOU

Should you or any associate of your festivity be forced to cancel, you must advise us in writing. An annulment is not effectual until we receive a copy of your written notice. To cover our anticipated loss caused by the termination and as we may be incapable to resell your holiday, termination fees, exclusive of insurance, will be levied per person as follows: Period before departure annulment charge (as percentage of total Tour price paid where germane)

CANCELLATION POLICY
Nullifications accrued will be subject to the following penalty of tour cost:
101 days and above 20%
61-100 days 30% of tour cost
46-60 days 50% of tour cost
16-45 days 80% of tour cost
0-15 days 100% of tour cost
NB. Nullification fees are based on the date your written divulgence is received at Gorilla Safari Experience Ltd.

COMPLAINTS
Complaints must be reported instantly to our delegate and to the supplier of the service(s) in question, who will do their best to resolve any problem. If you remain discontented, a written report should be submitted to the Safari manager in Kampala as soon as possible after the confrontation and not later than 20 days after close of your holiday, to enable us to scrutinize them fully. Lamentably, liability for any complaints not notified in accord with this procedure cannot be acknowledged.

FORCE MAJEURE
we lament we cannot acknowledge liability or pay reimbursement where the performance or appropriate performance of our obligations is prohibited or exaggerated by any event which we or the supplier of the service(s) in question could not, even with all ample care, predict or avoid. Such events embrace war or threat of war, riots, civil discord, border closures, unforeseen government acts, terrorist activity, industrial disputes, natural or nuclear tragedy, extreme weather conditions, fire, road closures, pilferage, epidemics, quarantines, dangers confrontation to sea, land and air travel, and other similar acts or incidents ahead of our ability to control.

We procure transportation, hotel accommodations, restaurant services medical emigration services and other services from an assortment of sovereign suppliers that are not subject to our control. We cannot therefore be predisposed for any death, personal injury, property damage or other loss that may happen due to any act or exclusion of any such supplier, or by reason of any other event over which we have no control.
We set aside the right to modify US Dollar prices without notice to replicate noticeable increases in foreign exchange or tariff rates before receiving the deposit from you. We also reserve the right to withdraw a tour or any part of it, to make such alterations in the itinerary as it deems necessary or enviable, to decline, to accept or keep hold of a member of any tour any person at any time, and to pass on to tour members any disbursement or losses caused by delays or events beyond our control.

Depending on the itinerary you have preferred, discretionary activities will be available at some of the places you will visit. Some of these activities carry with them the intrinsic risk of personal injury. These activities include, but are not necessarily partial to:
Walking tours
Canoe, boat and white-water rafting trips
Gorilla tracking
Chimpanzee tracking
Mountaineering
Balloon tours

You should be aware that your personal safety cannot be surefire. Should you opt for such activities while you are on tour, you are, of course, free to do so. Conversely, you must understand that such involvement will be at your own risk and that we presume no conscientiousness for your safety.

GORILLA PERMITS
only when imbursement has been received can permits for gorilla tracking in the pertinent National Park be purchased. Getting a gorilla permit is not a warranty of seeing a gorilla. Local conditions sometimes mean that access to the gorillas is made unfeasible at short notice. We are unable to acknowledge liability for any condition that might lead to gorilla viewing being terminated, whether it is closure of the National Park or borders; absence of the gorillas; security changes. Refunds are at the prudence of the pertinent authority and we cannot accept liability for them. We shall use our maximum endeavors to obtain a refund and if a refund is paid by the pertinent authority, we shall pass it on to the client,
Note that the probability of seeing the gorillas stand at 98%.

INSURANCE
it is prudent that before undertaking a holiday with us that you have, suitable insurance for the type of holiday being taken. Such indemnity should fully cover death, individual injury, medical expenses, repatriation in the event of accident or illness or death, cancellation or limitation of the holiday by side and loss of, dent to, or theft of the clients’ individual property. Activities with a greater innate risk, such as mountaineering, animal tracking on foot, white-water rafting should be enclosed. Evacuation cover is provided by Gorilla Safari Experience for clients partaking a full safari package like yourselves.

JURISDICTION
the principal company is included in the Republic of Uganda and it plies under the laws of Uganda.

LIABILITY
we shall make every reasonable effort to guarantee that (a) all component parts of the holiday are supplied as described in the pamphlet and to a reasonable standard; and (b) our employees, agents, suppliers and sub-contractors implement ample care in carrying out our onus under the contract. We accept liability for what our employees, agents, suppliers and sub-contractors do or do not do (provided they were at the time carrying out work endorsed by us). If any part of your holiday is not provided as advertised and to a levelheaded standard, we shall pay you suitable reimbursement if your gratification of the holiday has been exaggerated and you have followed the complaints modus operandi set out in these terms and conditions. This acceptance of accountability is subject to the section involving to “Force Majeure” above and these Terms and Conditions normally. Our maximum responsibility in deference of complaints (except where death, personal injury or illness results, or where claims relate to loss or damage to chattels or luggage, which are dealt with below) is partial to an amount equal to the cost paid by or on behalf of the person exaggerated for the pertinent services. The maximum amount will only be allocated where the person exaggerated has derived no gain from the holiday and none of the services tapered have been provided. Accountability for loss or dent to luggage or personal possessions (including money) will be remunerated to a maximum of US$30 on the basis that the client is tacit to have taken out tolerable insurance cover in deference of such losses at the time of booking.

We will take all ample care to avert your death, injury or illness being caused by the animal or insect life of the destinations. It is your duty to take proper medical and practical safety measures in this regard and your notice is drawn to the section in the Travel Notes relating to Health. Medical guidance should be sought well before travelling. Subject to these Terms and Conditions, we admit liability should you or any of your party undergo death, personal injury or illness as a result of any malfunction to perform or inappropriate performance of the contract by any of our employees, agents, suppliers or sub-contractors (provided they were at the time carrying out work sanctioned by us) except in the following situations. We will not be accountable where any failure to perform or inappropriate performance was due to: (i) the acts or omissions of a third party not associated with the stipulation of the holiday under the contract and which were unforeseeable or inexorable; (ii) an event which we or the supplier of the relevant services could not have foreseen or avoided even with all ample care. Any claim must be notified to us in harmony with the complaints modus operandi set out above. Any person to whom any imbursement is made (and their parent or guardian if that person is a minor) must allot to us and our insurers any rights they may have to chase any third party in relation with the claim and provide all necessary aid to us and our insurers that be reasonably required.

MEDICAL REQUIREMENTS
Good physical and mental health is vital for the gratification of these active, outdoors tours. You may travel in craggy areas removed from modern medical facilities. Good physical conditioning is recommended as preparation for all tours, especially those relating to trekking.
By transferring the payment, the customer certifies that he / she has no physical or other disability that would pose a risk to him or her or to other travelers. It is vital that any contestant with a medical condition requiring standard treatment or which may be exaggerated by dynamic activity, high altitude, heat, cold, other natural experience, or particular foods, notifies us and the tour leaders, in writing in advance of travel.
We presume no responsibility for medical care or for special nutritional requirements if not clued-up long in advance. The medical necessities by some places like Ngamba Island are a solitary liability of the client to meet them. We bring Ngamba Island and the client in direct contact so that he is furnished with what is requisite of him before walking with the chimps.

PAYMENT
At the time of booking you must verify approval of these terms and conditions and pay a deposit of 30% of the price of your holiday including fees for gorilla permits. If written approval is not received from you, we shall presuppose approval of the Terms and Conditions once you make the deposit. The balance must be paid in full before the start of the safari. It could be remunerated before coming or just before the start of the holiday. We however set aside the right to appeal for full sum at least 30 days before start of the holiday.

PHOTOGRAPHY ON TOUR
we reserve the right to take picturesque images of individual participants to use for marketable endorsement of our safaris. Tour members who prefer that their image not be used are asked to classify themselves to their tour guide at the start of the tour.

QUOTATIONS/BOOKINGS/PRICES
kindly ensure that the citation given with details of number of clients, dates, lodging, transportation, permits, park fees and all other services to be provided is lucid and precise before confirming the booking in writing. All references to quotations in writing shall comprise allusion to correspondence by duplicate and electronic mail. The price of your preferred holiday will be incorrigible at the time of booking. We reserve the right to correct errors in both advertised and deep-rooted prices and will do so as soon as we become conscious of any such error. However, every care is taken to guarantee that we provide right figures.

In case such a condition arises, if you are required to pay more than 10% of the original holiday price, you will be permitted to cancel your holiday with the full repayment of all the money paid to us except for fees paid for gorilla permits. Should you decide to cancel under these requirements, you must exercise your right to do so within 14 days of warning to you of the appendage. We reserve the right to augment or lessen the prices of unsold holidays at any time.

SAFARI TERMS
Prices EMBRANCE  airport transfers; accommodation; meals as avowed; the services of an English-speaking driver/guide and a 4×4 safari vehicle; portage of two items of baggage per person; boat trips; park fees; gorilla and chimpanzee permits where suitable. Prices ELIMINATE all items of a individual nature such as ingress visas, tips, telephone calls, laundry, gifts, airport taxes and all drinks. In Arusha, Kampala, Goma, Nairobi, Entebbe or Kigali the prices comprise bed and breakfast only. On safari the prices cover full board. The company coffers the right to diverge the safari services approved with the client in the occasion of unforeseen situations, such as road closures, bad weather, problems with national parks or hotels, safety considerations. In such cases unconventional preparations will be made as situation permit.

TRANSPORTATION
we guarantee that every person is permitted to a Window seat in the vehicle. Every effort is made to guarantee that vehicles are provided in a roadworthy state but no millstone can be accepted for breakdown, or any damage or impediment. Our guides are instructed to follow our code of conduct for Guides (available on request), which you must not ask them to rupture in any way. In the occasion that a Guide does not pursue the code, please notify the Safari Manager in Kampala. Company vehicles must only be driven by the company’s Guide whose choice on all matters, such as the route taken, is final. You will be responsible for any harm caused to a vehicle by any intervention by you with the vehicle, including legal costs. In case of breakdown, it’s our liability to remedy the situation. We can either remove the vehicle in question or restore it or if the breakdown is minor and can be rectifies, we set aside the right to do so.

VOLUNTARY EXECUTION
My progression of a deposit to Gorilla Safari Experience certifies that I have cautiously read and wholly understood the contents of the Terms and Conditions, particularly those vis-à-vis cancellation and refund policies, limitation of accountability, and responsibility borne by trip participants. On the advance of a deposit to Gorilla Safari Experience Limited., the depositor, his or her family and heirs concur to be bound by the above Terms and Conditions.
